About Hortory

Hortory is a gardening platform that allows users to:

  • Create digital gardens
  • Upload garden photos
  • Tag and track plants
  • Record observations
  • Share gardens publicly
  • Contribute to plant identification

Eligibility

You must be at least 13 years old to use Hortory.

If you are under 18, you should only use the Service with permission from a parent or guardian.

You are responsible for ensuring that the information you provide is accurate and kept reasonably up to date.

Your Account

You may need to create an account to access some features.

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activity that occurs through your account

We may suspend or terminate accounts if:

  • These Terms are violated
  • Content is unlawful or abusive
  • The account poses security or legal risk
  • We are required to do so by law

User Content

"User Content" means any content you upload or submit through the Service, including:

  • Garden photos
  • Profile information
  • Garden descriptions
  • Plant tags
  • Observations and notes
  • Identification proposals
  • Cultivar submissions
  • Feedback or messages

You confirm that:

  • You own the content or have the rights to upload it
  • The content does not infringe third-party rights
  • The content is lawful and not abusive or misleading

You are responsible for your content.

Ownership of Your Content

You retain ownership of your original content.

However, by uploading content you grant Hortory a worldwide, non-exclusive, royalty-free, transferable, sublicensable licence to:

  • Store and display your content
  • Process and optimise images
  • Crop, extract and transform plant images
  • Analyse and classify plant data
  • Improve search and identification systems
  • Support research, analytics and product development
  • Create derived materials and datasets
  • Operate and improve the Service

This licence allows us to operate Hortory and develop the platform.

Derived Data

Hortory may generate new materials from user content and platform activity, including:

  • Cropped plant images
  • Plant-photo datasets
  • Search indexes and metadata
  • Identification signals
  • Trend and popularity data
  • Aggregated horticultural insights

Hortory owns these derived materials.

They may continue to be used even if the original content or account is deleted, as explained in our Content, Data and Deletion Policy.

Public Content

Some features allow gardens or profiles to be made public.

If you make content public:

  • It may be visible to other users or visitors
  • It may be indexed or shared by third parties
  • Removing it later may not remove copies made elsewhere

You should only make content public if you are comfortable doing so.

Acceptable Use

You must not:

  • Upload unlawful or infringing content
  • Attempt to access accounts without permission
  • Interfere with the Service's operation or security
  • Upload malicious code
  • Misrepresent your identity
  • Scrape or extract data without permission

We may remove content or restrict accounts that violate these rules.

Third-Party Services

The Service may rely on trusted third-party providers such as:

  • Supabase (database and authentication)
  • Vercel (hosting and analytics)
  • Resend (email delivery)
  • Cloudflare Turnstile (bot protection)

These services operate under their own policies.

Early Release Status

Hortory is an early-stage application.

Features may change, be incomplete, or be removed.

We do not guarantee uninterrupted availability.

Disclaimer

The Service is provided "as is".

Plant identification results, recommendations, or other horticultural information may not always be accurate.

They should not be treated as professional horticultural advice.

Limitation of Liability

Nothing in these Terms limits liability that cannot be limited by law.

To the extent permitted by law, Hortory is not liable for:

  • Indirect or consequential losses
  • Loss of data caused by user actions
  • Loss resulting from reliance on user-submitted content

Changes to These Terms

We may update these Terms periodically.

Updates will be posted within the Service.

Continued use of Hortory means you accept the updated Terms.

Governing Law

These Terms are governed by the laws of England and Wales.
